It is the responsibility of the user (hereinafter, the “User”) to be aware of the General Sales Conditions (hereinafter, the “GENERAL SALES CONDITIONS”) in effect at the beginning of the Purchase process.
By accepting the conditions, the User declares to be of legal age and to have sufficient legal capacity to be bound by these GENERAL SALES CONDITIONS.
Please carefully review the product information to understand its specific sales conditions. These GENERAL SALES CONDITIONS may be supplemented or modified by specific clauses or conditions indicated for certain products, especially regarding the right of withdrawal, exchanges, or refunds.
ROLS CARPETS may modify these GENERAL SALES CONDITIONS at any time. Such modifications will not affect purchases made before the effective date of such changes, which will be governed by the GENERAL SALES CONDITIONS in effect at the time of the purchase.
These GENERAL SALES CONDITIONS can be saved and reproduced at any time by the User making a purchase through their Internet browser options and must be read and accepted before completing the purchase.


User Registration


To access the online purchase of ROLS CARPETS products, it is not necessary to register as a user on the website (www.rolscarpets.com). Purchases can be made without registration.
User registration is free and must be done through the “Register” tab on the website. At the end of the registration process, the User will receive an email at the provided address confirming that the process has been completed successfully.
The User can access the registered user section with their username and password (or using the means that ROLS CARPETS enables for user authentication in each case). In their profile, the User can find relevant information, such as previous orders or the shipping address provided.
The User can unsubscribe at any time by sending an email to the address: info@rolscarpets.com.
Offer Validity Period
Without prejudice to specific legislation, offers or electronic contracting proposals will be valid for the period established by ROLS CARPETS or, failing that, for as long as they remain accessible to recipients.


Purchase Process


The purchase process consists of the following steps:
(i) Product selection: Browse our website and click the “Add to Cart” button each time you want to add a product to your purchase. The shopping cart will display the selected product’s name, quantity, and price in euros.
(ii) Start of the purchase process: To initiate the purchase process, click the “Proceed to Payment” button.
(iii) Completion of purchase details: Before selecting the payment method, you must fill in your purchase details and correct any errors in their entry. Once you have verified your details, confirm your order.
(iv) Payment method selection: Select your preferred payment method, accept these GENERAL SALES CONDITIONS by checking the corresponding box, and click the “Place Order” button. At that moment, the contract will be considered finalized for all purposes.
(v) Purchase confirmation: Once we receive your acceptance, ROLS CARPETS will issue an on-screen confirmation that you can save and that will contain the following information:
Order number.
Order date.
Summary of the products included in the purchase.
In any case, ROLS CARPETS will send a purchase confirmation by email within 24 hours of receiving the purchase order.
Throughout the purchase process, you can consult these GENERAL SALES CONDITIONS and find out the final price of the selected products.
Once the purchase is confirmed, the customer cannot modify or cancel the order except in cases provided by law or in these GENERAL SALES CONDITIONS.


Price, Taxes, and Shipping Costs


All prices indicated on the website are in euros and include applicable taxes and fees for the Spanish territory, notwithstanding that purchasing products from another territory may entail corresponding taxes and/or tariffs. ROLS CARPETS will withhold the final order amount using the User’s bank data entered on the website.
At the end of the purchase process, the User must choose the desired shipping method. Shipping costs will be detailed at the end of the purchase process and will be fully borne by the User.
Before accepting the order, the User can view the complete final price, including any applicable increases or discounts, as well as shipping costs, taxes, tariffs, or other additional services, if any.
Product prices may change at any time depending on ROLS CARPETS’ pricing policy. The products purchased will be invoiced at the price in effect at the time of the purchase.


Payment


Users can make payment for the products purchased by any of the following means:
a) By debit or credit cards issued by European financial institutions.
Payment for the User’s order occurs in real time through the Virtual POS once it has been verified that the provided data is correct.
b) Through PayPal.
c) By bank transfer.


Invoice


The User accepts that ROLS CARPETS will send the purchase receipt by email to the address provided by the User. The User can revoke their consent to receive the invoice in electronic format at any time by sending an email to info@rolscarpets.com. Additionally, the User can always request a paper copy of the invoice by emailing info@rolscarpets.com.
Additionally, ROLS CARPETS allows the User to download the invoice from the “My Orders” section in the User’s personal account section. After selecting the order for which the User wants the invoice, they should click the “Download Invoice” button.
If an order was placed as a guest and, therefore, there is no personal account, a new account must be created with the same email address used for the order, following the steps explained above.


Delivery


Orders will be shipped to any of the following countries: Mainland Spain, Metropolitan France (including Corsica), Belgium, Netherlands, Italy (including Sardinia and Sicily), Portugal, Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, Germany, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Monaco, Poland, Romania, Slovakia, Slovenia and Sweden.
Home delivery will be made from Monday to Friday. The User can specify any shipping details and delivery method according to the options provided by ROLS CARPETS. Additional charges for transportation and product delivery will be communicated to the User during the purchase process.
In the event that the shipment is made outside of Spain, please contact us at the following email address: info@rolscarpets.com, where you will be informed of the shipping methods and costs for the selected destination, provided it is listed in this clause.


Delivery Responsibility


The User will acquire ownership of the products once they have left our warehouses.
ROLS CARPETS will not be responsible for any theft, robbery, damage, or loss of products that occurs after delivery of the products to the User.
Each delivery is considered made from the moment the product is made available to the User or to a third party authorized by the User, as evidenced by the control system used by the carrier. It is the recipient’s responsibility to check the order at the time of delivery and make any justified reservations and claims, including the option to reject the package if it has been opened or shows clear signs of damage.
ROLS CARPETS will be released from its delivery obligations as provided in the preceding clause and disclaims all liability in the following cases:
a) In cases of non-payment by the User, in accordance with current law.
b) Omission or inaccuracy of the information that the User must provide in the purchase order when placing the order.

Availability


In the event of unavailability of the product after the order has been placed, the User will be notified by email of the cancellation.
ROLS CARPETS does not guarantee the permanent availability of products and shall be exempt from any liability as long as it does not result from willful misconduct on the part of ROLS CARPETS or errors in the availability of the data transfer networks beyond its control.


Returns

A) Withdrawal
If the User is contracting as a consumer and user (in accordance with the definition set out in article 3 of Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Defense of Consumers and Users), they have the right to withdraw from the contract within 14 natural days without the need for justification.
The 14 natural days period mentioned in the previous paragraph will be calculated from the receipt of the products.
The User will not have the right to withdraw if they have purchased a personalized, custom-made product.
To exercise this right, the product must be in perfect condition. The User will be responsible for any decrease in the value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and operation of the products.
In case of withdrawal on the User’s part, ROLS CARPETS will refund the amounts related to the products, excluding delivery costs to the initial shipping address.
The refund of the purchase amount will be made using the same payment method used for the order, and in any case, within a maximum of fourteen (14) natural days from the date ROLS CARPETS receives the withdrawal request, provided that ROLS CARPETS manages the collection of the product. If the User returns the product through a transport company of their choice, the refund of the purchase amount will be made once ROLS CARPETS has received the product or, failing that, upon receipt of the product.
Return costs resulting from exercising the right of withdrawal will be borne by ROLS CARPETS.
If the products do not arrive in perfect condition, ROLS CARPETS reserves the right to refund a lower amount for the order, which may include the amounts that ROLS CARPETS must pay to the User for failing to comply with the obligations established here.
To exercise the right of withdrawal, the User must notify ROLS CARPETS, CALLE CALP (POL INDUSTRIAL FAYMA), S/N – NAVE 70 – Alicante, telephone (+34) 96 540 09 79, and email info@rolscarpets.com, of their decision to withdraw from the purchase made through a clear and unequivocal statement, by postal mail or email.

B) Defective or Damaged Product During Transportation
Before opening a product, the User must verify (i) the conformity and condition of the packaging and (ii) that the number of packages delivered corresponds to what is indicated on the transport document. If the User detects any anomaly before opening the product, ROLS CARPETS requests that the User not open the seal or packaging and that they write “accepted with reservation” on the transport document, specifying the reasons for their dissatisfaction.
Furthermore, if the product has been damaged during transportation, it is essential for the User to note this on the carrier’s delivery note.
If the User is not satisfied with the condition of the products received, they must contact ROLS CARPETS immediately by phone at (+34) 96 540 09 79 (from 8:00 a.m. to 6:00 p.m.) or by email at info@rolscarpets.com, and always within 24 hours of receiving the order.
In the case of a defective product or one that has arrived damaged, ROLS CARPETS will cover the shipping and return costs for the product. If the User wishes to return the merchandise with a different transport company than the one proposed by ROLS CARPETS, and the transport company selected by the User offers higher rates, the User will assume the difference in transport costs.

Warranty


In the event that the User acts as a consumer and user, all our products are guaranteed within the national scope against manufacturing defects for 2 years, except for products with a different specified period. If the products were purchased after January 1, 2022, the warranty period will be 3 years.
The warranty is expressly excluded in the following cases:
a) Transportation, accidents, improper use, and other damages not due to the normal use of the product by the customer after delivery of the goods. This warranty only covers damage during transportation that occurred before the material was received.
b) Transport of the product without the original packaging.
c) Burns, cuts, rubs, wrinkles, marks, scratches, or other damage caused by animals or improper use of the product.
d) Use or contact with chemicals (acids, solvents, dyes, paint, ammonia, lacquers, or other hairdressing products…) or treatment with cleaning products not intended for the specific upholstery of the guaranteed product.
e) Color deterioration due to exposure of the product to sunlight or other heat sources.
f) Indirect damages and losses of any kind.
g) Personal and/or material damages caused as a result of the User’s failure to comply with the rules and instructions provided by ROLS CARPETS for the installation, use, and maintenance of the product.


Force Majeure

ROLS CARPETS will not be responsible for the total or partial breach of the obligations arising from this contract or for the delay in their performance if such breach is due to force majeure, including general, territorial, or sectoral strikes, floods, fires, pandemics, etc.


Protection of Personal Data


In compliance with the provisions of Organic Law 3/2018 of December 5 and EU Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and the current regulations applicable at all times, we inform you that your personal data collected through this document will be processed by MOQUETAS ROLS S.A to fulfill the existing commercial relationship between you and our company.
Personal data may be disclosed to third parties when such disclosure is necessary for the development, compliance, and monitoring of the commercial relationship and/or is limited to the aforementioned purposes, in accordance with the current regulations in force.
You are informed that you can exercise your rights of access, rectification, cancellation, opposition, limitation of processing, and portability at any time at the registered office of the trader indicated above or by sending an email to the following address: info@rolscarpets.com.

Intellectual Property


ROLS CARPETS will retain all intellectual and industrial property rights, including trade secrets, related to all plans, standards, drawings, graphic material, photographs, design samples, content, and other documents, whether in electronic, printed, or pre-printed form or brochures, that will be delivered to the User in the context of the manufacture, testing, demonstration, and marketing of its products.
The User acknowledges that, under these GENERAL SALES CONDITIONS, ROLS CARPETS does not transfer or assign to the User any intellectual and/or industrial property rights owned by it or any third parties. ROLS CARPETS only authorizes the User to access and use them in accordance with the terms indicated in these GENERAL SALES CONDITIONS. Therefore, ROLS CARPETS does not grant any other license or authorization to use the intellectual and/or industrial property rights to the User other than what is expressly detailed in this clause.

Nullity or Annulment


If any of the clauses of these GENERAL SALES CONDITIONS are declared null, void, illegal, or unlawful, in such case, and to the broadest interpretative extent permitted by law:
a) Such declaration shall not invalidate the rest of the GENERAL SALES CONDITIONS, which shall remain valid and effective; and
b) The null or voidable clause or clauses shall be replaced or adjusted preferably to be annulled.
Applicable Law and Jurisdiction
These GENERAL SALES CONDITIONS shall be governed or interpreted, in all that is not expressly provided for herein, in accordance with Spanish law, and in particular by Law 34/2002 on Information Society Services and Electronic Commerce. The language for concluding the contract shall be Spanish.
ROLS CARPETS and the User agree to expressly waive any other jurisdiction that may be applicable and to submit any dispute that may arise from the provision of the products or services covered by these GENERAL SALES CONDITIONS to the courts and tribunals corresponding to the User’s domicile. Alternatively, the consumer may opt for the jurisdiction of the courts of the city of Alicante (Spain).
If the User is contracting as a consumer or user, nothing in this clause will affect the rights recognized to them by current legislation.
